Avoid the Tricks and Enjoy the Treats this Halloween: Lawsuit Prevention from MLG

Rena McDonald

Holiday season is upon us and McDonald Law Group would like to help you save the chills for the cooler nights and spooky fun, not with scary lawsuits. Here are some homeowner and neighborhood tips to keep you safe and protected.

Halloween safety rules help make sure that the worst thing to happen to the little ghouls around your neighborhood is a tummy ache from too much candy. Choose bright costumes and glow sticks or LED lights for your trick-or-treating kids. If you need to drive, stay at least 5 MPH below the speed limit on October 31st or anytime you see many children around.

For the pets in your home, the ASPCA recommends keeping candy away from Fido, keeping wire or hazardous decorations out of reach, and making sure to secure your pet as visitors come to the door. All of the unusual happenings can stress your pet and increase the chance of unusual behavior, like bites, on Fright Night.

As a homeowner, so long as you take reasonable precautions, you can be reasonably safe from liability in the event that some injury does occur on your property. Walkways should be lit and free from obstruction. Consider consulting your insurance agent to make sure your coverage is adequate and the policy is in force. We are happy to review your liability limits, too.

An ounce of prevention can help avoid a pound of liability.  There is nothing that can make you bullet-proof in preventing a lawsuit but proactive effort on your part and a good attorney at your side will help with things that go BUMP on Halloween Night!

Best wishes for a scary -- AND SAFE -- Halloween!

Business Owners in Southern Nevada...What Licenses Do You Need?

Rena McDonald

What business licenses are required in Clark County?

Operating a business in the greater Las Vegas area can lead to a lot of confusion about what types of business licenses are required. The most important question to ask is: Where is your business actually located?

Is it in Las Vegas city limits, Henderson, North Las Vegas? If so, you may need additional licenses to operate your business. Click on this link to the C.C. Jurisdiction Locator and enter an address or scan the map for an area you are considering and know before you file.

If you are in the 89141 area code, for example, you will need a Nevada State Business License and a Clark County Business License but do not need a City of Las Vegas Business License. The application fees are not refundable and neither is the time you take from your business trying to figure it out. Know before you go.

You will also need to know if your building allows for the type of business you are operating. Is it ADA compliant? Is there adequate parking? Is the building zoned for your use? All of this is relevant to whether or not you can get a license.

Many business owners look for property and then try to get licensing. Instead, you should consider the licensing requirements prior to committing to a lengthy lease which you will not be able to get out of if you can’t get the licenses you need. It could make the difference of deciding where in Clark County is best for your business...From Henderson to North Las Vegas and all points in between.

Navigating the greater Las Vegas Licensing requirements can be difficult, hire a professional to help you get it straight. Contract review, lease negotiation, compliance, and entity formation are all services available to our business owners on the Business Success Plan, available at McDonald Law Group.  If you have any questions regarding this article or would like to discuss licensing protection with one of our attorneys, please call us at (702)448-4962 to set up a free consultation.

3 Ways your Attorney Can Help Business Owners with IRS Tax Debt

Rena McDonald

As another tax filing deadline for businesses passes, tax debt negotiation becomes a valuable topic of discussion for those business owners who owe the IRS money. If you owe the IRS for this most recent year and/or for any years prior you may have options for  managing your IRS tax debt. We will cover three of those options.

Bankruptcy. Many people are not aware that their tax debt with the IRS may be discharged by filing bankruptcy. Eligibility for discharge under Chapter 7 or Chapter 13 of the bankruptcy code requires the debt to have been assessed by the IRS at least 3 years prior to the date of filing your bankruptcy.

Offer in Compromise. This is a program where you can settle your debt for less than what you owe.  Your attorney will negotiate with the IRS on your behalf and request for them to accept a lump sum or short payment plan for a lower amount than what is owed. This is a great option for businesses that have a lump sum of money available to send to the IRS in consideration of the reduction. Typically, you can expect the IRS to accept a 30% to 50% of the original debt as a full and final payment.

Installment Agreement. The third option is to negotiate a payment plan arrangement which can result in a low monthly payment. This is a good stress-reducing option for those that do not have the ability to make a lump sum payment .

There are other options available but we have found these three options to be the most successful when helping our clients eliminate their tax debt with the IRS. As every client has unique needs and circumstances, your situation deserves the overview from a caring, competent attorney with your best interests at heart. If you have IRS issues, please contact the office for assistance. We offer a full range of legal services for business owners.
